I, hereby acknowledge that I have voluntarily applied to enter onto and to engage in or observe shooting and other activities at SHOOTERS TEXAS, LLC (the “Range”). I further acknowledge and understand that “shooting and other activities” include all activities of any kind whatsoever in which I engage or observe while at the Range, regardless of the sponsoring party. In consideration for being allowed to voluntarily use the facilities and participate or observe shooting activities and other activities at the Range, I, the undersigned participant, hereby agree to the following terms and conditions:

Rules and Regulations: I understand that the safe and responsible use of firearms is of utmost importance. By participating in shooting activities at the Range, I acknowledge and agree to abide by all rules and regulations established by the Range for the safety of all participants. Failure to adhere to these rules and regulations may result in my immediate removal from the premises without refund or credit.

Range Rules:

• EVERY GUN IS LOADED: TREAT EVERY GUN AS IF IT IS LOADED AND DANGEROUS.
• ONLY POINT AT IT IF YOU WANT IT DESTROYED: ALWAYS KEEP YOUR FIREARM POINTED DOWNRANGE AND NEVER POINT YOUR FIREARM AT ANYTHING YOU ARE NOT PLANNING TO SHOOT.
• MIND THE TRIGGER: KEEP YOUR FINGER OFF THE TRIGGER AND OUTSIDE THE TRIGGER GUARD UNTIL YOU ARE ON TARGET AND READY TO FIRE.
• IF IT’S LOADED, LEAVE IT ON THE LINE: CHECK TO MAKE SURE YOUR FIREARM IS UNLOADED, THE ACTION IS OPEN AND THE SAFETY IS ON BEFORE BRINGING IT OFF THE FIRING LINE.
• PROTECT YOURSELF: WEAR PROTECTIVE EYEWEAR AND EAR PROTECTION AT ALL TIMES, EVEN WHILE NOT SHOOTING.
• CHECK YOUR FIREARM: ALWAYS MAKE SURE YOUR FIREARM IS FUNCTIONING CORRECTLY, PROPERLY CLEANED AND SAFE TO USE.
• KNOW YOUR TARGET AND BEYOND: ALWAYS KNOW WHAT YOU ARE SHOOTING AT AND BE MINDFUL OF WHAT IS AROUND AND BEHIND YOUR TARGET.
• BE SAFE: KEEP YOUR FIREARM SAFETY ON AND ACTION OPEN UNTIL YOU ARE READY TO FIRE.
• ALCOHOL AND GUN POWDER DON’T MIX: IT IS ABSOLUTELY PROHIBITED TO BRING ALCOHOL INTO THE SHOOTING RANGE.

Firearms Safety: 

I understand and agree to abide by all safety rules, regulations, and instructions provided by the Range staff. I acknowledge that failure to follow these rules may result in my immediate removal from the premises.

Assumption of Risk: 

I understand and acknowledge that the use of firearms and participation in shooting activities involves inherent risks, including but not limited to the risk of emotional or physical injury, including paralysis or death, property damage, and exposure to loud noises, wildlife, insects and bugs. Further risks include but are not limited to being shot by or shooting myself or others, partial or total loss of eyesight or hearing, inhalation or other harmful contact with lead or other contaminants and being struck by flying or falling objects. I understand that such risks cannot be eliminated without compromising the essential qualities of shooting activities. I further acknowledge and understand that the nature and condition of the Range facilities, premises and environment is such that both known and unanticipated hazards exist which create or contribute to both known and unanticipated risks inherent in entering onto the Range, in using the Range facilities and in engaging in or observing any activities of any kind whatsoever while at the Range. I voluntarily assume all such risks and agree to observe activities or use the Range facilities at my own risk.

Release of Liability: 

I agree that I, my next of kin, heirs, guardians, representatives and assigns HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE AND AGREE NOT TO SUE  Shooters Texas, LLC or its assigns (I understand that includes any and all members, officers, directors, attorneys, agents, employees, contractors, volunteers, guests and affiliated individuals or organizations of ) from and against any and all claims, demands, damages, expenses, causes of action, attachments of property, or liability of any kind whatsoever, that I, my next of kin, heirs, guardians, representatives or assigns may have, including but not limited to, property damage, personal injury or death resulting from me entering onto the Range, using Range facilities or equipment, or engaging in or observing shooting and other activities at the Range, even if such claims, demands, damages, expenses, causes of action, attachments of property, or liability result partially or wholly from any act or acts, even any negligent act, reckless act or omission to act, including negligent or omitted first-aid or rescue operations or procedures, by Shooters Texas, LLC Range staff.

Indemnification: 

I agree that I, my next of kin, heirs, guardians, representatives and assigns HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS Shooters Texas, LLC or its assigns (I understand that includes any and all members, officers, directors, attorneys, agents, employees, contractors, volunteers, guests and affiliated individuals or organizations of) from and against any and all claims, demands, damages, expenses, causes of action, attachments of property, or liability of any kind whatsoever, including  reasonable attorneys’ fees and costs, that I, my next of kin, heirs guardians, representatives or assigns, my Guests, or anyone else, may have, including but not limited to property damage, personal injury or death, whether suffered by me, by my Guests, or by anyone else, resulting from me or my Guests entering on to the Range, using Range facilities or equipment, or engaging in or observing shooting and other activities at the Range, even if such claims, demands, damages, expenses, causes of action, attachments of property, or liability result partially or wholly from any act or acts, even any negligent act or omission to act, including negligent or omitted first-aid or rescue operations or procedures, by Shooters Texas, LLC Range staff.

1. Tracer and Incendiary Rounds and Devices: I acknowledge that tracer and incendiary rounds or any explosive devices or materials are not permitted on the premises of the Range. I agree not to use or possess tracer and incendiary rounds or any explosive devices or materials while using the Range facilities.
2. Rifle Ammunition: Only frangible rifle ammunition is allowed in the Range.
3. Rental Guns: Guns rented from the Range may only be used with Shooters Texas, LLC ammunition.
4. Ammunition Inspection: Any ammunition brought into the Range will be subject to inspection by the Range staff.
5. Shotgun Ammunition: Only slug ammunition for shotguns will be allowed in the Range.
6. Drawing From a Holster: Drawing from a holster is prohibited in the Range, except in training scenarios supervised or approved by a Shooters Texas, LLC Range instructor.
7. Rapid Fire: You may shoot as fast and accurately as you believe your skill level allows. If the Range Safety Officer believes you are unsafe shooting rapid fire, they will require you to cease immediately and resume normal fire sequence.
8. Medical Treatment: Although, Shooters Texas, LLC has no duty to undertake first-aid or rescue operations or procedures in the event of any physical or emotional injury or medical emergency, or property damage, I authorize the Range staff to seek and provide medical treatment for me as deemed necessary, and I agree to be financially responsible for any costs associated with such treatment.
9. No Warrant: Shooters Texas, LLC makes no warrant as to the design, manufacture, maintenance, condition or fitness for any particular purpose of any Range facilities or equipment, including, but not limited to firearms, ammunition, eye/hearing protection, and first-aid supplies.
10. Photography and Likeness: I consent to the use of any photographs, videos, or likenesses taken of me during my time at the Range for promotional or informational purposes by the Range.
11. Applicable Law: I acknowledge and agree that is agreement shall be interpreted and enforced under the laws of the state of Texas, and that the venue for any action or proceeding shall be the State of Texas, without regard for the conflict of law rules of the State of Texas. I agree that any action at law (including arbitration) requiring to enforce or interpret the terms of this agreement, will be entitled to reasonable attorney’s fees, cost, and to any other relief to which may be entitled. I further acknowledge and agree that this agreement is intended to be as broad and inclusive as permitted by law, and that if any provision or portion is held to be invalid, void, or otherwise unenforceable, I agree and intend that the remaining provisions or portion shall continue and remain in full legal force and effect. I further acknowledge and agree that it is my understanding and intent that this Agreement, and any signed written amendments or modifications to it, shall remain in full force and effect from the date of execution and ever after and Shall be applicable to each and every occasion that I enter onto the Range, use Range facilities or equipment or engage in or observe shooting and other activities at the Range. I acknowledge that no other inducement, assurance or guarantee has been made to me in consideration of my signing this Agreement, which I sign voluntarily and of my own free will, I further acknowledge and agree that this Agreement may be amended or modified only by a writing signed by me and by an authorized agent of Shooters Texas, LLC.
